Terms and conditions

The terms on which you may use this website, and how they sit alongside the separate agreement that governs an actual OPFCC Manager installation.

Who these terms are with

This website at www.onepieceauto.com.au is published and operated by One Piece Automation (ABN 50 690 467 577) of Seaford, Victoria, Australia. In these terms, “we”, “us” and “our” mean One Piece Automation, and “you” means anyone who visits or uses the site.

By using this website you accept these terms. If you do not accept them, please do not use the site. If you are using it on behalf of a business, you are agreeing to them for that business as well as for yourself.

What this website is, and is not

This site describes OPFCC Manager — the One Piece Forecourt Controller Manager — an unattended self-service fuel payment platform we build, install and support. It is a description of the product. It is not the product.

There is no login, no account and no self-signup on this site. It does not connect to any forecourt controller, does not run any station, does not process a fuel sale and takes no payment of any kind. The only thing you can send through it is an enquiry.

Nothing on this website is an offer capable of acceptance, and nothing on it creates an agreement to supply OPFCC Manager, hardware, installation or support.

These are not the terms of a supply agreement

If you go on to buy OPFCC Manager, that supply — the software, any hardware, the site survey, installation, commissioning, training, support, fees and every other commercial term — is governed by a separate written agreement between you and us, issued after the site survey.

These website terms govern your use of this website and nothing else. Where they differ from a supply agreement, the supply agreement prevails for everything it covers.

Information on this site is general

What this site says about the platform is written to explain what OPFCC Manager does in general. It is not a statement of what it will do on your forecourt.

Controller compatibility, pump and grade mapping, available payment methods, hardware, signage, installation timeframes and price are confirmed by us in writing after a site survey. We name the two forecourt controllers the platform runs on today; anything else is a question the survey answers, and we do not warrant compatibility with any particular controller or dispenser in advance of one.

  • Product views on this site are illustrative. Transactions, figures, prices, card numbers and references shown inside them are sample data, not real records, and every such view says so on the page.
  • Photographs, diagrams and forecourt illustrations depict a typical station. They are not photographs of a customer’s site and are not evidence of an installation.
  • The site carries no prices, no statistics, no customer counts and no case studies. Where a number belongs to your forecourt, it comes from the survey.
  • We keep the site as accurate and current as we can, but we do not warrant that it is complete or free of error, and we may change it at any time without notice.

Enquiries you send us

The contact form sends your enquiry to us by email through a small relay we run ourselves. Sending one does not oblige either of us to anything beyond our reading it and coming back to you.

Please give us accurate details, and do not submit someone else’s personal information through the form without their knowledge. The form is not a confidential channel: if you need to discuss something in confidence, call us or email us directly and say so.

  • The form carries a hidden field that only automated submissions fill in, and the relay limits how many enquiries one network address can send in a period. Both exist to keep the inbox usable.
  • If a genuine enquiry is caught by either measure, email or phone reaches the same people and skips the form entirely.

How you may use this site

You may read this site, and print or save pages of it, for your own information or to evaluate OPFCC Manager for your business. That permission is not a transfer of any ownership, and we can withdraw it.

What you must not do

  • Copy, republish, sell or licence the site’s content, or present it as your own or as part of another product or service.
  • Use the site or its content to build, market or train a competing product, including harvesting it in bulk with automated tools.
  • Interfere with the site, the enquiry relay or the systems behind them, or try to reach any part of them not intended for public use.
  • Probe, scan or test the security of the site or the relay, other than under a written engagement with us.
  • Submit anything unlawful, misleading, defamatory or malicious through the contact form, or use it to send bulk or unsolicited messages.
  • Represent that you are associated with, endorsed by, or an agent or reseller of One Piece Automation when you are not.

Intellectual property

The site and everything in it — text, structure, design, illustrations, diagrams, photographs, the product views and the code that draws them — is owned by us or licensed to us and is protected by copyright.

“One Piece Automation”, “OPFCC Manager”, “One Piece Forecourt Controller Manager”, “OPFCC Manager Sign” and our logo are our trade marks, whether registered or not. Nothing on this site gives you a right to use them.

Other people’s names and marks

Names of other companies, products and services appear on this site only to describe what OPFCC Manager works with — forecourt controller and dispenser brands, the payment gateway, card schemes, fleet card products and mobile wallets. Those names and marks belong to their owners.

Naming one does not mean its owner endorses, sponsors, certifies, or is affiliated with us or with OPFCC Manager, and does not mean we are its authorised reseller or agent.

Availability of this website

We do not guarantee that this website is available, uninterrupted or free of faults, and we may change, suspend or withdraw any part of it at any time without notice.

That says nothing about a live OPFCC Manager installation. The availability of an installed site, and what happens if something goes wrong with it, are dealt with in the supply agreement for that site, not here.

Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Where we are liable to you under a consumer guarantee for services that are not of a kind ordinarily acquired for personal, domestic or household use, and it is fair and reasonable to do so, our liability is limited — at our option — to supplying the relevant services again, or paying the cost of having them supplied again.

Disclaimers and liability

Subject to the section above, this website and its content are provided as they are, and to the extent the law permits we exclude every other warranty, condition or representation about them, whether express or implied.

  • We are not liable for any loss or damage arising from your use of, or reliance on, general information published on this site, and you should confirm with us how anything here applies to your forecourt before acting on it.
  • To the extent the law permits, we are not liable for indirect or consequential loss, or for loss of profit, revenue, fuel sales, goodwill, data or business interruption, however it arises out of this website.
  • You are responsible for your own device, connection and security, including for any virus or malicious code that reaches you when you use the internet.

Privacy

Personal information you send through this site, and personal information handled in the OPFCC Manager platform, is dealt with under our Privacy policy, which forms part of these terms.

Changes to these terms

We may update these terms as the site and the platform change. The current version is always the one published here, and the date at the head of this page is the date it last changed. Continuing to use the site after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and of the courts able to hear appeals from them.

This site is directed at businesses in Australia. If you use it from somewhere else, you do so on your own initiative and you are responsible for complying with the law where you are.

If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply.
